Estimating the Incidence of Rape and Sexual Assault by
The Bureau of Justice Statistics' (BJS) National Crime Victimization Survey (NCVS) measures the rates at which Americans are victims of crimes, including rape and sexual assault, but there is concern that rape and sexual assault are undercounted on this survey. BJS asked the National Research Council to investigate this issue and recommend best practices for measuring rape and sexual assault on their household surveys. "Estimating the Incidence of Rape and Sexual Assault" concludes that it is likely that the NCVS is undercounting rape and sexual assault. The most accurate counts of rape and sexual assault cannot be achieved without measuring them separately from other victimizations, the report says. It recommends that BJS develop a separate survey for measuring rape and sexual assault. The new survey should more precisely define ambiguous words such as "rape," give more privacy to respondents, and take other steps that would improve the accuracy of responses. "Estimating the Incidence of Rape and Sexual Assault" takes a fresh look at the problem of measuring incidents of rape and sexual assault from the criminal justice perspective. This report examines issues such as the legal definitions in use by the states for these crimes, best methods for representing the definitions in survey instruments so that their meaning is clear to respondents, and best methods for obtaining as complete reporting as possible of these crimes in surveys, including methods whereby respondents may report anonymously. Sadly, accurate information about the extent of sexual assault and rape is difficult to obtain because most of these crimes go unreported to police. In R. v. Ewanchuk, the Supreme Court of Canada held that sexual touching must be accompanied by express, contemporaneous consent. In doing so, the Court rejected the idea that sexual consent could be "implied." Ewanchuk was a landmark ruling, reflecting a powerful commitment to women's equality and sexual autonomy. The debate between feminist and evolutionary scholars about sexual violence has resulted in polarized ideas about whether sex offendersOCO motives are sexual, nonsexual, or both. Spivak examines the history of this controversy, and then evaluates national victim survey and police data to test hypotheses about victim-targeting in rape incidents. The primary question is whether offenders preferentially select victims based on youth, or more indiscriminately based on convenience and proximity, examining the age distribution of victims and offenders across relationships and other measures of routine activity. Results reveal that offenders may be more sexually motivated than implied by some feminist assertions, since they appear to specifically target younger victims, but these facts are explainable within a criminological framework that does not require a direct evolutionary adaptation."
The Shaming of Sexual: Risk, Retribution and Reintegration by

Child sexual abuse is a small component of the broader category of 'gendered and sexualised violence' which causes significant trauma for victims yet continues to evade conventional approaches to justice. This is evidenced not only by the low number of prosecutions, due mostly to low levels of reporting and evidential difficulties at trial, but also by the failure of the justice system to prevent re-offending, largely due to the limited availability and effectiveness of prison treatment programmes. Following Braithwaite's dichotomy of 'reintegrative' and 'disintegrative' shaming, this book argues that contemporary popular and state-led responses to the risk posed by sex offenders are largely disintegrative in nature. At best, the offender may be labelled, stigmatised and ostracised from the community, while at worst, he may be subjected to violence and vigilante action and ultimately return to offending behaviour. The failure of these retributive responses means there is considerable scope for exploring alternative forms of justice and their potential for improving the outcome for victims, offenders and communities affected by sexual offences.This book examines the controversy of whether restorative justice can be applied to child sexual abuse as one of the most intractable of contemporary societal problems, and if so, what special considerations might apply. Although restorative schemes with sex offenders are in short supply, a few initiatives have developed in Canada and parts of the United States which have effected significant benefits in 'reintegrative shaming.' The book examines whether such ad hoc schemes may be of general application with child sexual abuse and whether they may be implemented on a more holistic basis.
